          UN Convention on International Settlement Agreements Resulting from Mediation and China’s Opening-up Forum

          INVITATION

          Dear Participants:

          For the purpose of fostering the use of mediation for international commercial dispute and establishing a cross-border enforcement mechanism for international commercial settlement agreements, the United Nations Commission on International Trade Law (“UNCITRAL”) commenced study and draft of UN Convention on International Settlement Agreements Resulting from Mediation (“Mediation Convention”) in 2014, and finalized the draft Mediation Convention on its 51st session held in New York July this year. The draft Mediation Convention is scheduled to be adopted by the General Assembly of UN later this year and will be open for signature of UN State Members next year. It is foreseeable that the Mediation Convention will exert a profound impact on international commercial disputes resolution.

          This year is the 40th anniversary of China’s Reform and Opening, the sustained and rapid development of China's foreign trade is inseparable from efficient and flexible dispute resolution. It has always been advocated that "harmony is the most precious" in Chinese tradition, and mediation has always been an important part of China's multiple commercial dispute resolution mechanism. The signing and implementation of the Mediation Convention in the future will undoubtedly promote the resolution of international commercial disputes, and have a positive impact on the development of China's opening-up and the improvement of China’s business environment.

          On November 6th, 2018, during the first China International Import Expo, the Mediation Convention and China’s Opening-up Forum (“Forum”), hosted by the Ministry of Commerce of the People's Republic of China, organized by the China International Economic and Trade Arbitration Commission (“CIETAC”) and CIETAC Shanghai Sub-Commission, will be held in Shanghai. Speakers in the Forum are supposed to include honorable guests from the United Nations Commission on International Trade Law, the National People's Congress, the Supreme People's Court, relevant ministries of the State Council and international dispute resolution institutions, local and global reputable dispute resolution experts as well as professionals in legal field. We look forward to welcoming you at the Forum and witnessing the development of international commercial mediation and China's opening-up.
