          Announcement on the Renewal of CIETAC Panel of Arbitrators in 2020

           
          According to relevant provisions of the Arbitration Law of the PRC (Arbitration Law), China International Economic and Trade Arbitration Commission (CIETAC) maintains a Panel of Arbitrators. The arbitrators’ duty is to compose the arbitral tribunal either by the nomination of the parties or the appointment of the CIETAC Chairman, and resolve the disputes between the parties in an impartial and independent manner. The professional competence and integrity of the Arbitrators are important foundation for the handling of arbitration cases, and the key to promote the efficient and impartial resolution of disputes.

          In accordance with the CIETAC Rules for Appointment of Arbitrators, CIETAC applies a system of 3-year tenure to its Panel of Arbitrators. The current term of the CIETAC Panel of Arbitrator will expire on 30 April 2020. The renewal arrangement of the CIETAC Panel of Arbitrators is as follows:

          I. Conditions for CIETAC Arbitrator Application

          In accordance with Article 13 of the Arbitration Law, the CIETAC Code of Conduct for Arbitrators and Rules for Appointment of Arbitrators, the following conditions shall be met for applying to be a CIETAC arbitrator:

          1. Devoting to arbitration, with a fair, upright, and noble character; Able to hear cases in adherence to the principle of independence and fairness;

          2. Supporting the Articles of Association of CIETAC, and willing to abide by the CIETAC Arbitration Rules, Code of Conduct for Arbitrators, Rules for Appointment of Arbitrators, and its other relevant regulations;

          3. Being honest, diligent, prudent, with good insights and judgment, highly efficient and willing to learn, and with strong oral or written communication skills;

          4. Fulfilling the requirements specified in Article 13 of the Arbitration Law, which are: i. Having passed the China’s National Judicial Examination, obtaining the legal professional qualification certificate, and having been engaged in arbitration work for at least 8 years; ii. Having worked as a lawyer for at least 8 years; iii. Having served as a judge for at least 8 years; iv. Having been engaged in legal research or legal education, possessing a senior professional title; v. Having acquired the knowledge of law, engaged in the professional work in the field of economy and trade, etc., possessing a senior professional title or having an equivalent professional level, with rich experience in dealing with practical problems as well as high reputation in the respective industry or field;

          5. Mastering a foreign language and able to use it as a working language, which requirement may be relaxed to a certain extent for a few well-known professionals;

          6. Ensure sufficient time for handling arbitration cases;

          7. No record of criminal penalties, party disciplinary or professional disciplinary sanctions;

          8. In principle, not exceeding 65 years of age (by 1 May 2020);

          II. Submission of Application Materials

          1.Any person who meets the above conditions and voluntarily applies to be a CIETAC arbitrator, please fill in the online arbitrator application form on CIETAC’s official website (www.daegutex.com) before 24:00, 20 January 2020. If you have already finished the online application after February 2017, you do not need to submit it again.

          If you cannot fill in the submission online, you are suggested to download the application form attached, and send the completed application form to arbitrators@cietac.org.

          2.According to Article 3 of the CIETAC Rules for Appointment of Arbitrators, the applicant shall also submit one or two written recommendation letters from CIETAC arbitrators, experts or professors, and ensure the authenticity and accuracy of these materials. Only a few domestic or international well-known professionals may be exempt from submitting recommendation letters.

          The recommendation letters and other materials, if any, shall be mailed to CIETAC Supervision and Coordination Division, 6/F, CCOIC Building, 2 Huapichang Hutong, Xicheng District, Beijing 100035, P. R. China

          III. Training, Review and Appointment

          1. CIETAC will organize arbitration training for those applying for CIETAC arbitrators. Specific training arrangements will be notified through email and be posted on CIETAC official website. Due to the limited number of seats for each training session, it may not be able to accommodate the needs of all applicants. Those who have participated in the arbitration training, please do not sign up again.

          2. Those who participate in and pass the training will obtain a certificate. This certificate will be the reference for the appointment of arbitrators in 2020 and later.

          3. The CIETAC Secretariat will conduct a preliminary examination of the application materials (including training record), and then submit all the approved applications to the CIETAC Arbitrator Qualification Examination Committee for review. Those applications that pass the review will be further submitted to the CIETAC Chairmen’s Council for final decision. CIETAC will release the new Panel of Arbitrators on 1 May 2020.
